MYSTIC ESTATES TIER FREE COMMERCIAL COVENANT
NOTE: The few Tier Free Commercial units we have are currently occupied as of January 2014 for Mystic Mall II and Fashion Village. We have 2 Tier FREE Commercial Units in the Builders Emporium and 1 Tier Free Commercial Unit in Mystic Mall III. This Covenant applies to only those who occupy a tier free location.
The Tier Free Commercial Covenant governs over Tier FREE Commercially zoned rentals and units of Mystic Estates. Please read the covenant in its entirety. Failure to comply with the covenant will result in loss of tenancy. Tier Free stores are subject to in-world contract of exclusivity of location. Meaning you can only qualify initially for a Tier Free Store if you agree to have no other location in Island Oasis. (Agreement must be made before tenancy begins.) Our goal is provide a unique shopping experience for residents of Island Oasis. If you are found to have another store selling the same items you will lose your Tier Free location with Mystic Estates. Neither do we allow those in the Tier Free Store locations to rebrand and still sell same items or sell on an alt under a different name. There is no reason to come to one of the Mystic Darkstone Design mall locations if your items can be found in other places on the grid. There are many other FREE locations to get a FREE store if you are just looking for multiple locations. Other restrictions may apply depending the region. See in-world Staff for Agreement.
If accepted for a Tier Free store the following Covenant will govern your rental.
Clubs and Adult rated Service Businesses are not allowed.
We do not “sell” land only rent it. *All stores are parceled to make sure your store location is searchable on its own with its own landing point and to allow the customization of your about land settings. There is nothing worse for a Merchant than to be lost among the masses of a mall and not seen in search and not have your own landmark with your own logo on it. As a tenant you receive the following privileges for your own parcel as if you were the owner:
* Naming your parcel
* Writing the Description of your parcel
* Choosing various About Land options such as enabling Fly, Creating objects, Object entry, Run Scripts, Safe Mode, No pushing, Show in search
* Setting the image (snapshot) for your land-this will appear as YOUR landmark image.
* Setting the Landing Point
* Setting the teleporting route
* Setting the Media
* Setting the Audio
* Managing your own Ban list (through the Parcel Set up page)
* Access to members only sandbox
* Access to free furnishings (business furnishings)
* Free Basic Business Scripts

RULES PT 1:
• Don't Exceed your prim count - prim counts are checked and will return items that exceed the rental allowance.
• First prim count over allotted will result in a warning and items being returned in 24 hours if you have not picked up the items yourself. (this is a courtesy for everyone here so that you do not use a neighbors prim count nor can they use yours). Second prim count over allotted will result in surcharge of $100L per every 10 prim over and immediate return of items until your prim count IS within your allotted prim amount. Failure to pay the penalty fee for prims over paid allotment of prims will result in immediate termination of your rental with NO REFUNDS.
• If you choose to leave early there will be no refund for early termination.
• If in arrears, Eviction occurs in 1 days. Anyone else can rent the box when in arrears, so its in your best interest to pay rental before the expire date.
• Heavily scripted objects are not allowed. (if in doubt please ask)
• Keep your Prims inside your rental - we will return any and all prims outside your rental structure or parcel.
• NO Particles without prior approval and no particles that flow out of your shop rental. Objects that violate this will immediately returned.
• NO bright light objects, eg: objects with glow which can be seen from a distance through other peoples shop walls or objects - (Glow allowed at .05 or less only)
• Keep "floating text/hovertext" to a MINIMUM, its very annoying for your neighbors to see your hovertext bleeding into their shop. Limit items with hovertext to the back wall only of your rental shop. (Unless the back of your store is against another store wall)
• NO split pay scripts (this causes unnecessary lag)
• NO multi vendor scripts. (this causes unnecessary lag)
• NO sales vendor systems (the scripting used takes away from the collective scripting memory limit allocated to the region and affects all of us here
• If selling scripts the script must be turned OFF inside the prim you are selling it in OR you may leave it running as long as its double boxed. (The boxed script is sold INSIDE another box). It is in the best interest of all here to minimize taxing the scripting memory limit of the sim. This will allows those visiting our regions to have a more pleasurable experience. (In other words: Crash or lag out the sim and there are no shoppers)
• Copybotted, stolen or unlicensed products for sale or resale are NOT allowed. If you are using someone else's sculpt maps, mesh, kits or other items to create or for resale you must have obtained a license to properly do so. It is YOUR responsibility as a merchant to ensure that your products have full licensing for sale at any and ALL Mystic locations. Mystic fully supports the protection of IP rights for all digital artists and creators. Anyone found in violations of these rules will be ejected from land group, have ALL items returned, tier will NOT be refunded.
NOTE: Mystic runs a clean and HONEST business model and we will NOT sit by while our fellow creators are ripped off. The best policy is to 1- CREATE your own items or 2- Obtain licensing for the elements you are using for resale.
RULES PT 2 AND ADDITIONAL INFORMATION:
1. Tenancy requires membership in the Mystic Darkstone Commercial Estates group in order to rezz on your residential parcel.
2. Membership in the group for our private sandbox is optional, but needed if you plan to use the Members Only sandbox.
3. Parcels that have a store provided are not to be moved nor the outside of the structure covered up in any way except with your logo or with trim and adornment. This is to preserve the aesthetic value in keeping with the surrounding stores.
4. You may rezz items only within your store, with the exception of a maximum of 3 items outside the store but they must be flush against your store rental.
5. Do not use items with a hovertext against walls which can be read inside a neighboring store.
6. Rezzing off-sim decorations and other items is not allowed.
7. You may not rezz fencing and other structures around the outside of your store location.
8. If you are rezzing an item that comes packed in a rezz box, make sure to freeze the build and remove the rezz box. Do not leave the rezz box out. (Freezing it, depending on the scripts in the rezz box, normally removes the running scripts that were necessary to rezz your structure.)
9. We realize that it takes time to set up your Commercial location but we do ask that you not clutter your store or parcel and with boxes in the process and that the prims (sculpts or mesh) used be textured. (no default or blank textures)
10. Do not use your store or parcel as a sandbox. We have a free Member’s only sandbox available to all tenants.
11. You are not automatically added to the sandbox group. Just let Staff know to add you.
12. You may not rezz items in the sky.
13. Do not rezz shouting objects.
14. No ban lines are allowed.
15. Security orbs are not allowed on Commercial locations. We will only support businesses that allow their commercial venue to be open to the public. (As a tenant, we respect your right if you decide not to allow certain residents to come to your location. You will have the ability to manage your own Ban List for your own Commercial location). This rule does not apply to those renting a full region.
16. Terraforming is not allowed. This is to preserve the aesthetic value of the sim.
17. We reserve the right to deny any structure inside your store if deemed unacceptable to region standards, but at the same time respect your right to have the commercial location of your dreams. We want your stay here to be enjoyable. When in doubt if something is allowed please contact one of our staff members.
18. No soliciting or advertising for businesses, clubs or other locations from any Mystic Darkstone Design mall location. Unless participating in a sales event such as a grid wide hunt, Pay It forward Program, fashion show etc
19. No group inviters, greeters, nor signs that solicit business or encourage residents to go to other shopping locations are allowed on Mystic Darkstone Design regions. Unless participating in a sales event such as a grid wide hunt, Pay It forward Program, fashion show etc
20. No escorting from any Mystic Darkstone Design mall location. No sex and no avatar nudity in Mystic Darkstone Design Malls. Avatars must be clothed at all times. Selling a skin which shows avatar parts may be allowed if tastefully displayed.
21. No glow on objects that bleed through to another tenants parcel. This rule does not apply to those renting a full region.
22. Prims outside of a store are not to be set on full bright since this greatly disturbs the view in midnight setting.
23. No ambient lighting that light up another tenants store front.
24. Limit instances of ambient lighting since this can affect the sensation of lag where multiple instances of ambient light are present in the same sim in close proximity to one another.
25. We prefer no particles, but realize some items do have them. Make sure no particles go past your parcel or sim boundary. Limit the number of rezzed items with particles since this can directly affect the regions performance. You may be asked to turn off particles if we see this is a problem visually or with sim performance.
26. No weapons that project prims into another parcel or waterway.
27. Be respectful to Mystic Estates Staff members and other tenants of Mystic Estates. Harassment and/or stalking of any kind will not be tolerated.
28. No rezzing on other tenants parcels.
29. No griefing of any kind on any Mystic Estates regions.
30. If you have a dispute with a neighbor report it to Mystic Estates Staff at your earliest convenience, and provide proof of claim (screen shot, chat log etc)
31. No excessive scripting or scripted objects which may cause lag.
32. If you have menued furniture or items please go the menu before you leave your parcel and click stop. This uses simulator memory unnecessarily.
33. If you are using more resources than the size of your land allows, (prims or excessive scripting) a Staff member will discuss the options with you. Options may include renting a larger parcel, deleting prims and/or scripts or ending tenancy. Instead of ejecting a tenant, we would rather work with you in hopes of finding a good solution.
34. Scripted pets are not allowed to be rezzed but may be allowed for sale as long as the product is double boxed so that the scripts will not have an effect on sim performance. One rezzed sample pet is allowed in store.
35. Breedables are not allowed to be rezzed but may be allowed for sale as long as the product is double boxed so that the scripts will not have an effect on sim performance. One rezzed sample Breedable is allowed in store.
36. Guests on your parcel(s) are subject to the same rules of your tenancy and as such, you are responsible for guest behavior. Land owners and visitors have to abide by the covenant.
37. You may have additional persons on your rental contract. See Staff to ensure they are given the correct group tag and thus allowed to also rezz items.
38. Whether it is the primary renter or a co-tenant the prim count for the parcel applies to the total number of prims collectively rezzed on the parcel.
39. Do not enter another merchants store or business to solicit at their location without their permission.
40. Mystic Estates and Staff assume no responsibility for grid outages. We do not compensate for time lost since this effects everyone grid wide and is beyond our control.
41. Regions are restarted weekly on an automatic schedule for preventative maintenance, but you may request a region restart though the customer service system online.
42. Regions are backed up weekly on an automatic schedule for preventative maintenance.
43. Mystic Estates Staff reserves the right to visit any region or parcel to check covenant violations or the region performance.
PRIM COUNTS AND PAYING TIER:
Keeping a low lag environment is of prime concern, thus you will not see rental boxes on the parcels. They are collectively stored at the Real Estate office thus reducing the number of running scripts in every region that we have parcels available. Residential parcels and Stores that are available for use do not use a single prim count on the parcels, thus again there is no need for prim counter scripts since each parcel shows only YOUR rezzed prims and you will always know your true prim count by looking at "About Land" under the "Objects" tab without the need of a script.
Tier can be paid with in-world currency known as $Ps, PayPal, Visa, MasterCard, Discover or American Express. Never pay a Staff member directly. Only make payments through the rental boxes at the Real Estate Office or through our website.
All Tier payments can be made on the region Mystic Darkstone Design 2 at the Real Estate office with in-world currency ($Ps). Through the Real Estate office you can pay as little as a single week at a time or pay as far in advance as you wish.
For your added convenience we offer secured payment options such as paying tier through PayPal, credit or debit card on our website for the majority of our parcels. When paying tier through the website, the minimum payment is 4 weeks, but can also be purchased for as far in advance as you wish.
If paying with a credit or debit card, click to choose your parcel to pay for, when you get to ‘Your Shopping Cart’ screen click “Check Out” or “Check Out with PayPal” when you get to the next screen choose the link on the right hand side of the screen that says “Don’t have a PayPal account” and that will take you to another screen where you can pay with a card. DO NOT ATTEMPT PAYMENT WITH A PRE-PAID CARD.
As a tenant it is your responsibility to be aware of when tier is due. If paying through the Mystic Estates Real Estate office rental boxes you will be sent reminders when you are close to the expiration of your current rental. When paying online you will receive a receipt in-world with the tier expiration date printed on it for your records.
If tier lapses we (Mystic Estates Staff) will assume you are no longer continuing tenancy and your parcel will be checked for prims you may have left behind. Any prims remaining on the parcel will be returned for your convenience instead of deleted. Returned prims will typically appear as a coalesced item in your lost and found folder of your inventory. Your place as tenant in the Land group will also be removed when you are no longer a tenant. If you have also joined the private sandbox group your membership there will end along with your tenancy.
All tier is non-refundable.
Existing tier payments can be transferred only towards a larger parcel if you are moving to another Mystic Estates location as long as arrangements have been made with staff in advance.
If you are in need of additional prim please make arrangements with Staff to see what we can offer you and what the associated cost would be. Many times we are able to offer you bonus prim in addition to what your parcel prim limit states
SUPPORT:
We ask for your feedback and that you report any time you have a problem, question or concern. Staff online indicators are at the Real Estate Office for you to see who is currently online. If staff is not currently online we ask that you contact us through our Customer Service online. (Or notecard the issue in lieu of an IM which could be lost) Staff will check the mailbox at the Real Estate Office daily but its best to actually contact us through our online Customer Service if we are not in-world since we will get that quicker. Use the link to our online site then select whether you need tenant support or just general support.
If you have a personal dispute with another tenant, typically Mystic Estates will not interfere. We would hope that residents resolve disputes between themselves in a mature and respectful way. If the dispute involves our covenant or TOS violation we ask that you contact us promptly. We will do all that we can to see that the matter is quickly attended to. Our goal is to help you make the most of your in-world experience and provide the best in virtual Real Estate and our Customer Service.

If tier lapses we (Mystic Estates Staff) will assume you are no longer continuing tenancy and your parcel will be checked for prims you may have left behind. Any prims remaining on the parcel will be returned for your convenience instead of deleted. Returned prims will typically appear as a coalesced item in your lost and found folder of your inventory. Your place as tenant in the Land group will also be removed when you are no longer a tenant. If you have also joined the private sandbox group your membership there will end along with your tenancy.
All tier is non-refundable.
Existing tier payments can be transferred only towards a larger parcel if you are moving to another Mystic Estates location as long as arrangements have been made with staff in advance.
If you are in need of additional prim please make arrangements with Staff to see what we can offer you and what the associated cost would be. Many times we are able to offer you bonus prim in addition to what your parcel prim limit states

We ask for your feedback and that you report any time you have a problem, question or concern. Staff online indicators are at the Real Estate Office for you to see who is currently online. If staff is not currently online we ask that you contact us through our Customer Service online. (Or notecard the issue in lieu of an IM which could be lost) Staff will check the mailbox at the Real Estate Office daily but its best to actually contact us through our online Customer Service if we are not in-world since we will get that quicker. Use the link to our online site then select whether you need tenant support or just general support.
If you have a personal dispute with another tenant, typically Mystic Estates will not interfere. We would hope that residents resolve disputes between themselves in a mature and respectful way. If the dispute involves our covenant or TOS violation we ask that you contact us promptly. We will do all that we can to see that the matter is quickly attended to.
